Cohabitation – Is Reform on its Way?
In last month’s publication of our journal, there was an article on the “Top Three Legal Myths’, which included the myth regarding cohabitation, i.e. of there being no such thing as a ‘common law wife’, or a ‘common law husband’, or indeed a ‘common law marriage’, that is to say a couple who are living together, with or without their children, and are not married or under a civil partnership. As was shown, the conception of such a thing is, in fact, a misconception – and it can be a serious one at that. If that relationship breaks down, such couples have extremely few rights when it comes to aspects such as finances, property and most seriously of all, the children of their relationship,

You’ve probably heard it before: your self-esteem impacts every part of your life. The truth is, if you want to be successful at work, you need to feel confident in yourself and the value that you bring. Building self-esteem isn’t easy, but it is possible!
It is not unexpected that many people find it difficult to request higher pay. Especially once their job hunt is over and they have an offer. They do not want to risk the opportunity now that they've made it this far.
Everyone in the legal profession is confronted with a degree of administration duties. As a legal secretary this is an area you are expected to lead on. You may have years of “admin” experience and already consider yourself an expert, but it can be very beneficial to take an assessment of your current skill level from time to time. You may also just be starting in the legal profession, so we will start with the basics before considering what kinds of advanced skills would help you achieve expert status.
Our Legal Secretaries Diploma Course is suitable for a wide variety of individuals, whatever their experience, whatever their schedule and wherever they live in the world.
Personal and professional growth comes from acting in ways that support our health, values, and goals. Turning our awareness towards what we really want from life and doing things that make us happy enables us to live more authentically and in alignment with ourselves.
When it comes to job hunting, people get overwhelmed by the number of numerous strategies at their disposal. Some may send hundreds of applications to companies hiring employees, while others may reach out to acquaintances within the industry to help secure a job. Nonetheless, it all comes down to one thing – networking. Networking doesn’t mean pestering people with your problems. With limited time on our hands, it is only possible to network with a few people, especially those within your field.
Partly because of the pandemic and perhaps because of years of chronic under-investment, the UK court system is under pressure. Case numbers are rising and the time taken for claims to reach trial is increasing year on year. More use of alternative dispute resolution is seen as a solution, so there is a proposal to make it compulsory in commercial disputes. We will consider the case for this and compare how compulsory mediation has worked in family matters where it has been a feature for nearly 10 years.
‘Quiet Quitting’ is the new buzz phrase, born from lockdown where people have started to re-evaluate their priorities and work/life balance. Gathering speed on social media, it essentially means ‘just staying within the parameters of your job description’ – doing no more, and no less, than what is required by your contract. For example, no more staying late at work, checking emails outside of your contracted work hours, or volunteering to do the ‘nice to have but not really necessary’ jobs, such as organising social events outside of office hours.
Many of us have a basic understanding of some aspects of the law, but there are a few areas where myths seem to persist. For example, is there such a thing as a Common Law wife or husband? Does a Will guarantee your wishes will be followed after your death? And if you break the law unwittingly because you genuinely didn’t know the action you took was illegal, the courts will be lenient. These are three commonly held beliefs – but how accurate are they?
Blogs are a fantastic, but often shamefully underrated resource. Think about it, where else can you access free, constantly updated, and tailored information from some of the world’s lead thinkers in their area?
Introducing, Dr Avi Bhangal
This is the third and final article this year on reforms to civil procedure where we will outline the Court’s expanding use of online case management systems.
The saying "the eyes are the window to the soul" is a popular one. According to hiring experts, an interviewer can tell whether you are telling the truth or lying through eye contact, or lack of. Interviewers can often pay a lot of attention to your eyes and body language during an interview. This means that the importance of eye contact in non-verbal communication holds a great deal of importance.
With the cost of living continuing to rise and the colder months on the way, many of us will be worrying about our energy bills over winter and into next year. Those of us who continue to work from home will have the added concern of knowing that we need to ensure we have an efficient and comfortable space to work from during the day, as well as a snug and relaxed place to enjoy in our free time, without sending already high bills even higher.
In a previous article on reforms to civil litigation, we looked at the expanding use of fixed costs. This month, we will consider the Civil Justice Council (CJC) review of pre-action protocols.
Some people choose a certain career path in life, as they feel that it is their calling. They are naturally gifted in their field and have a passion for what they do. In psychology, this is referred to as self-actualisation. Self-actualised people strive to achieve their highest potential and find meaning in their work. They love what they do and experience great joy in performing their roles. In respect of ILSPA’s Members, they can find their work interesting and rewarding and recognise that they make a significant contribution to their legal departments.
Simple queries can occasionally lead to embarrassing situations if one is not adequately prepared for them. The interview question “Tell me about yourself”, for example, should be a no-brainer. However, this typical interview question continues to baffle candidates of all levels of expertise. It may be claimed that this is partly due to the open-ended nature of the question, as it is not immediately clear if the interviewer is seeking a brief biography, a full CV or a combination of the two. These concerns, like those associated with any difficult interview topic, can be addressed with appropriate preparation and understanding of the interviewer’s rationale for asking the question.
What is a CV? CV is short for curriculum vitae, which is a Latin term meaning course of (one’s) life; it is a summary of a person’s career, education and qualifications in written form. A CV is also referred to as a résumé (French word) at times, but there is a difference. Résumés are usually single-page summaries of your work experience and background information, whereas a CV is usually longer and more comprehensive.
Temping is short-term work done by a candidate who is employed through a recruitment agency, is on their payroll and is paid hourly for the work they provide. As a temp candidate, you are not committed to provide notice, and a client can also end the assignment at any time, so there is a huge amount of flexibility for both parties. A temporary candidate is often sourced at the last minute to cover a period of absence, sickness or leave and can be used to assist in a wide variety roles and levels.
Checklists help you stay organised, better prioritise your time and see the “big picture.” They reduce the number of things you must remember, freeing up valuable headspace for the things that really matter. And if someone else needs to fill in for you, they have a step-by-step guide to tell them exactly what they need to do.
In the best of circumstances, striking a healthy work and life balance can be challenging, but it can become even more intimidating, as well as vital, during periods of economic stagnation and uncertainty.
An administrative role is a key part of any business. From dealing with office logistics to planning meetings and communicating with all levels of employees, getting your foot in the door can provide a stepping stone to a world of exciting opportunities. These entry-level positions are a great way to build a career. If you’re searching for the perfect entry-level admin role, here we reveal how to get a job in administration with no experience.
You have to be smart and on top of your game when you're about to answer interview questions. When asked a tricky question, you need to be able to answer confidently with something that not only appeals to the interviewers but stays relevant to you and your professional skills.
This month we will consider some changes to Part 45 of the Civil Procedural Rules (CPR) that will affect how legal costs are recovered in some civil cases. These changes were first suggested in the 2013 Jackson report, which considered whether more proportionate costs could be achieved with changes to procedures. Following consultations in 2019 it is now expected that in October 2022 there will be a significant development in expanding the use of fixed costs making way for the creation of “intermediate” cases.
We all know the phrases ‘a problem shared is a problem halved’ or ‘it’s good to talk’ but the benefits in talking about how you are feeling go far beyond this. When we are in a difficult situation, we lose our problem-solving abilities. It can be impossible to focus and it can seem overwhelming to choose what action to take. Sometimes a listening ear and a nudge in the right direction is all we need to move on. Social and emotional support and the role of individuals, families and communities in delivering this are vital to managing wellbeing. We all need someone to talk to about personal matters without judgement and in confidence. To listen to us and offer help when things get on top of us.
As an administrative professional, you’re used to working behind the scenes. However, to keep your career moving forward, you need to practice some self-promotion.
Before we start, we need to understand what a job interview is. It’s not to be taken lightly, especially if you want to land the job you are striving for. A job interview is a formal meeting between you and your potential employer.
Have you noticed that when you feel tired or stressed, it is harder to focus on your studies? There is a theory which explains that when our base needs are met, we can function better in life. This theory forms the hierarchy of needs and was developed by a famous psychologist called Abraham Maslow in the 1950s. It has changed the way we think about psychological health and is used in educational and therapeutic settings as well as workplaces to help people perform at their best. Abraham Maslow was one of the founding fathers of positive psychology and dedicated his life to studies in the field.

Bad day at work? Need to talk? Life in the law can be challenging and sometimes things can get on top of you. Talk to us – we’ve been there.
The thought of asking your boss for a pay rise or a promotion is always nerve-wracking, and can strike fear in the most confident of business support professionals. Not only do many people often overthink the approach but the assumption of a negative response or reaction to your request makes the idea of putting yourself out there feel a lot worse than it is.
The legal sector has long been fast-paced and high-pressure. For some, the number of deadlines to fulfil and the amount of information to remember might become overwhelming. Like many professionals, people in the legal sector have had to adjust to the ‘new normal' created by the COVID-19 pandemic, adding to their existing responsibility.
The introduction of “no-fault” divorce at the beginning of 2022 brought one of the biggest changes to matrimonial law for 50 years. There are more changes afoot; this month we will consider one reform that has already been enacted and one that like “no-fault” divorce is long overdue.
If you’ve followed me for long, you’ve likely heard me say that, aside from a current resume, a professional portfolio is the single best thing you can do for your career.
Everyone knows that attending a job interview is a nerve-racking experience – and it doesn’t get easier with age!
Some civil disputes could be characterised as emotionally charged, but few are as contentious and hard fought as matters involving the home. This month we have two examples of highly contested cases and a call from the court for compulsory ADR.
Last month, over 9 million people across the world came together to show their care for our planet’s future. By switching off their lights for an hour at 8.30 p.m., they demonstrated that small actions can make a big difference. During the darkened hour, people sat by candlelight and had the opportunity to reflect on how they could reduce their impact further.
Those lucky enough to work remotely at the start of the COVID-19 era were able to keep themselves and their companies going, despite the intense pressures of that challenging time.
One of the many exciting aspects of working as a Legal Secretary is the fact that there is so much possibility for career progression. Experienced Legal Secretaries can become executives in their own right, but many also choose to move on to roles such as that of a Paralegal. Making the decision to move forward into a new role such as this is both exciting and rewarding, but you would be forgiven for feeling slightly daunted about beginning. You have made a successful career as a Legal Secretary, so how can you take that next step up to become a Paralegal? And how can you make sure that you stand out in a sea of other legal professionals and law graduates?
When was the last time you made an effort to catch up on your filing? Last month? Last summer?
The law is not something we have to actively go looking for – it governs our daily lives. Thus, those interested in the subject can use a variety of tactics to become more familiar with it.
Setting goals is an important part of building a long and successful legal career. For many, the ultimate goal as a Legal Professional is to secure a position with one of the biggest legal firms in the City, working on high-profile clients and gaining seniority in a competitive field.
The long-anticipated era of “no-fault” divorce came into force on 6 April 2022, nearly two years after the passing of the Divorce, Dissolution and Separation Act.
Take a look around your workspace. Is it organised or a disaster area? Can you quickly and easily find things? Are there any items that are just taking up space?

Professional development is essential for every admin, regardless of experience. But when that training comes with a large price tag, it’s often out of reach.
In last month’s edition of our journal, we outlined the Solicitor Regulation Authorities’ continuing competency regime. This has been in place for all legal businesses since 2016 and is something that all legal employees are expected to follow. The skill of self-reflection was considered, and a challenge was given for readers to identify the following:
One thing is for certain, there is no one set way into the legal industry! No matter which role you are interested in – Solicitor, Paralegal or Legal Secretary – there are multiple paths you can consider to reach your goal.
The new year is a great time to reflect on how you can help yourself, others and the world around us. As time goes on, we are becoming more and more aware of the effect we are having on the planet and what we can do to reduce our impact. If you would like to make some meaningful New Year’s resolutions, here are some ideas:
This might strike you as a relatively mundane topic, but in legal practice, file opening is something that everyone in a law firm should be familiar with. That is not to say that everyone in the firm will be entrusted with this important task, and it is often well-trained admin and support staff like Legal Secretaries who are required to do this work.
The new year is often a time for budgeting and looking for good deals. As ILSPA students are eligible to purchase a TOTUM PRO card, we wanted to share some exciting updates and information for 2022.
Imagine that you’re going on a vacation. You’ve spent months researching your destination. You have a detailed itinerary of everything you plan to do when you arrive. The excitement is building, and it’s almost time to set off.
In many industries, the line between managers and workers tends to be fairly clear. Managers manage; workers work. An employee in a retail setting, for instance, generally isn’t responsible for handling their manager’s schedule, making calls and sending emails on the manager’s behalf, or preparing the manager for important meetings.
For many years now, the team at

The COVID-19 pandemic brought with it so many changes, many of which occurred almost overnight. One of the largest that has impacted almost all of us has been remote working. For some, this was temporary, but for many of us, this is the new normal, and with offices unlikely to return to 100% capacity in the future, embracing a remote working style is crucial for us all.
