5 Critical Differences Between the Legal Systems in the USA and the UK

As the professional body for Legal Secretaries and PAs in the UK, ILSPA provides courses which are based on the English Legal System. However, one of the fascinating things about law and the legal sector in general is the variation between different legal systems and how they operate around the world.

ILSPA’s partner, Simply Law Jobs, recently caught up with Russell Michelson from Jezic & Moyse to discover the five critical differences between the legal systems in the USA and the UK:

Statements of Truth Update

As part of the regular updates made to the Civil Procedure Rules 1999 (CPR), there was recently a significant change made to the wording used for statements of truth. This month we will look at why statements of truth are important and explain what has changed.

Why are statements of truth important?

The Power of Learning as an Assistant

If you are not sure where to start your learning journey, then I suggest you ask yourself what role you want to be in three to five years’ time. What industry do you see yourself in? What new responsibilities would you like? What does your future role look like?  It could be that you are in the same role, but you want to be more confident and be operating at a higher level.  Having an idea of what you want your career to look like in the future will help shape a career plan and focus your learning to achieve these objectives.

There are two main areas where you may want to focus your learning and development:

Being Positive in the Face of Job Rejections

In a world full of greater competition, highly qualified candidates and fewer opportunities, job rejections are inevitable. With the COVID-19 pandemic impacting the global economy, many people are finding it harder than ever to look for jobs. However, job rejection is not always the biggest ordeal; it is the aftermath of job rejections, which begins with doubting yourself and your abilities, suffering from imposter syndrome, and feeling demotivated in pursuing a career in your chosen field. Candidates often find job rejections extremely disheartening, and it takes a toll on their mental health and their perspectives.

How to Choose the Right Paralegal Course

With the paralegal profession emerging as the fastest growing in the legal sector, it’s so important to choose the right course – one that is bespoke, fit for purpose and robust.

There are many providers who see a potential market for offering courses, and it is becoming a bit of a minefield, so here are a few tips about what you should be aware of before you take the step to pay for any paralegal course:

Are the paralegal courses expressed to be specifically paralegal, or are they general legal courses?

10 Tips for Starting a New Job Remotely

A number of firms are beginning to use virtual onboarding processes for new legal employees. We share our tips for making an impact when starting from home.

With new responsibilities, new people and new expectations, starting a new legal role can be an anxiety-inducing time even for the most seasoned professionals. But what if you’re starting your new job from your own home?

As a result of the health and safety measures designed to reduce the impact of the ongoing COVID-19 crisis, numerous employers are making use of virtual interview and onboarding processes. So, if you’re entering into a new role in the coming weeks or months, there’s a high possibility you will be doing so remotely.

Thriving in a Remote World

With everyone in the legal profession settling into a new remote-working normal, we will consider how you can enhance your skills when it comes to job hunting and interviewing online.

Starting on a positive note, the legal industry is generally very resilient even in uncertain times, so there is no reason to put off job hunting even if the general economy is struggling to get back to normal. You should prepare to be more patient as those who are recruiting for law firms are also trying to get to grips with juggling a new remote workforce. It may take some HR teams time to adjust to new technology and work routines, but this could be time that you spend developing your online skills.

Dispelling the Myths and Assumptions About Paralegals

With the Paralegal profession being acknowledged as the fastest growing within the legal services sector, it’s important to dispel some of the myths and incorrect assumptions that surround the profession.

All Paralegals are law graduates who wish to become Solicitors or Barristers

This premise is just wrong: many graduates still aspire to enter these conventional professions. However, not all graduates wish to become Solicitors or Barristers. Some may want to become career Paralegals or Paralegal practitioners. The cost of qualifying for the conventional professions is so prohibitive that many graduates see the Paralegal pathway as a viable career alternative.

Paralegals are just glorified Legal Secretaries

How to Get Hired During COVID-19

With the coronavirus pandemic still ongoing, it can be easy to believe that job hunting at the moment is an exercise in futility. In reality, however, many employers continued to hire throughout lockdown, and as businesses around the country reopen, the organisations that had put their recruitment drives on hold have resumed efforts to source new talent.

That being said, job hunting now looks very different than it did back in March, and competition for roles in the legal profession is fierce. With the number of vacancies on-site growing and confidence in the job market improving, we decided to put together this list of advice and tips for how to get hired during COVID-19.

Be patient

The Habit of Procrastination

You’ve unpacked the dishwasher, reloaded the dishwasher, descaled the kettle, updated your Facebook status to say how shocked you are at the amount of limescale in the kettle, made a frothy coffee, posted a photo of the coffee on Instagram and liked every article in your LinkedIn feed. You tell yourself it’s because cleanliness is next to godliness, you need the caffeine and you should engage with your connections. But the real reason is you don’t want to reformat the tables in the 300-page prospectus. Sound familiar?

Here’s another scenario: I took three days to write this article because I had to allow the ideas to develop in my mind before I put pen to paper. Was I delaying or was I procrastinating?

Video Interview Like a Pro

COVID-19 is having all kinds of far-reaching effects on everyone’s lives. And in recruitment, one of the biggest impacts is an inevitable switch to video interviewing.

But video interviewing has become far more common over recent years anyway. So, sharpening your video interview skills now won’t just be useful during this extraordinary period, but for your future career too.

Here are a selection of insider tips on video interviewing like a pro from everyone at Ambition.

Plan in advance

A video interview is no different from any other interview in terms of content. Don’t expect the questions to be any easier or the interviewer to be any more lenient.

Virtual Witnesses and Changes to Probate

Since lockdown, the social distancing rules have thrown up many issues for lawyers. Wills and probate lawyers warned the government at the start of the crisis that clients were finding it more difficult to make Wills. Worse still, this was happening at the very time when Wills were most needed. Many solicitors were able to find ways to still get the work done while maintaining social distancing, but this was not always possible. One of the most difficult problems was satisfying the requirement that a Will be properly witnessed.

We Need 1.6 Planets to Sustain Us

Every year, the Global Footprint Network (GFN) calculates Earth Overshoot Day. This is the day when our consumption exceeds the regeneration of nature on our planet. Last year this happened in July – however, due to the coronavirus, it was recorded on 22 August this year. As human activity has been limited, the earth has had a little bit of a chance to recover.

Interestingly, Earth Overshoot Day happens on different days for other countries. Some of the biggest consumers of the world’s resources are Qatar, whose Earth Overshoot Day is in February, and United Arab Emirates and America, where it is recorded in March. Countries such as Cuba, Iraq and Indonesia seem to consume the least, with the day being set in December.

5 Ways to Self-Motivate as a PA

A Personal Assistant (PA) is tasked with carrying out administrative and organisational duties on behalf of an executive in an organisation that may be private, public or non-profit.

Individuals also hire PAs to manage their busy schedules. PAs are required to be flexible and productive in the duties they are assigned, so they should stay motivated. When PAs self-motivate, they develop a drive from within that pushes them to focus on achieving both personal and organisational goals.

Q&A with Eleanor Lawson - Legal PA of the Year Finalist 2019

We are looking for the brightest and most talented Legal PAs for the PA of the Year Awards 2020. If you work in a law firm and want to celebrate the achievements of a colleague, or if you’re a Legal PA yourself whose hard work deserves some recognition, then we want to hear from you.

If you aren’t quite convinced to submit a nomination yet, read on to find out first hand from Legal PA of the Year finalist Eleanor Lawson about her experience with the PA of the Year Awards 2019.

Hello, Eleanor. How did you become a Legal PA?

The Benefits of Mentoring

Many office support professionals in the early stages of their careers are actively seeking mentors to help them develop and advance in the world of work. However, these professional relationships are by no means one-sided, often offering a range of benefits to mentors and mentees alike.

Despite the gradual easing of lockdown restrictions, many Personal Assistants (PAs), Executive Assistants (EAs) and office support professionals are still working from home, meaning they may have a little more time on their hands than they’re used to. If you’re an experienced PA or EA with knowledge to pass on, advice to give and stories to tell, why not invest a few hours each week in the learning and development of an aspiring professional?

The Re-Introduction of Commonhold

Those who have studied land law through an ILSPA course will already be familiar with the terms freehold and leasehold. These are legal definitions created by the Law of Property Act 1925 and relate to the extent of a person’s ownership of land. Another type of land ownership, commonhold, was introduced in 2002, but it struggled to establish itself and fewer than 20 commonhold developments have been built to date. This month, we are reporting on how this lack of interest in commonhold ownership may be about to change.

What’s AI and How Can it Help You in the Workplace?

Technology has long played a role in making the workplace more efficient — and artificial intelligence (AI) is no different. Capable of automating time-consuming and mundane tasks, AI is designed to make operations easier. In fact, it's already making positive changes in the legal profession, with the DoNotPay chatbots in London and New York being prime examples. Regarded as the world's 'first robot lawyer', the chatbots have helped over 160,000 people contest parking fines for free, and are now being trialled in small-claims courts.

What’s the Difference Between a Paralegal and a Legal Secretary?

Legal Secretaries and Paralegals are essential additions to any law firm. Both roles provide support for lawyers with preparing cases and general administrative work. But what’s the difference between a Paralegal and a Legal Secretary? This article will tackle that question and also provide you with insight into the similarities between a Legal Secretary and a Paralegal.

RESPONSIBILITIES

Legal Secretary

Legal Secretaries work in law firms to provide administrative support to lawyers. Daily tasks include producing legal documents, performing research, transcribing interviews, preparing legal forms, organising diaries and generally keeping the office running smoothly. Sometimes they also attend court, which can be interesting.

Calling All Superstar Legal PAs

SecsintheCity is looking for exceptional Legal PAs, EAs and Office Managers to be nominated for the PA of the Year Awards 2020. Could you be a winner?

Now in its ninth consecutive year, the PA of the Year Awards has become an iconic celebration of the essential support that Personal and Executive Assistants provide to the companies and individuals for whom they work.

The awards are hosted by SecsintheCity, the UK’s only job board dedicated to PAs, EAs and other office support professionals. The nominations are open from now until 14 September, after which an esteemed judging panel faces the challenge of choosing a winner in each of the following categories:

Dealing with Change

Dealing with change is undoubtedly the most stressful thing for humans to have to endure. No, allow me to rephrase that. Stress isn’t caused by change – change becomes stressful when we don’t adapt or roll with the punches. There are times when life throws you a barrage of many small, new – or even just slightly different – situations, people, rules, restrictions and routines, such as moving house or changing jobs. Then there’s the sucker punch of change that you don’t even see coming, the one that leads to an avalanche of sudden difficult decisions – think divorce or losing a loved one. And sometimes life tries to knock you out entirely with a combination of both: a global pandemic that changes absolutely everything, for everyone.

House Purchasing in 2020 – to View or Not to View

The COVID-19 pandemic has affected a lot of aspects of our lives, including buying houses. During the midst of the lockdown no viewings were taking place, causing stagnation in the housing market. As the rules have relaxed, people are now able to view properties they are interested in buying, but they must keep to the social distancing measures that have been put in place.

The government has advised house buyers to try to avoid viewing properties in person by doing it virtually where possible, but how does this balance with the legal risks of taking this approach?

How to Motivate Yourself to Study after Lockdown

The past few months have been a time of unprecedented change and disruption for many of us in our normal day-to-day lives. While for some this has led to additional time at home to dedicate to things such as courses and self-care, for others it will have led to the opposite. With work, family and schoolwork all needing to be squeezed in at home, there is little time left for other responsibilities such as studying.

Legal Secretary Job Interview Questions

A Legal Secretary needs to be dedicated, efficient and highly organised in order for a law firm or business to run effectively.

Therefore, when interviewing for a Legal Secretary position, employers are looking for much more than good administration skills. Legal Secretaries need to demonstrate a genuine interest in the law, as well as excellent customer service skills and adaptability.

You might be interviewing for your first Legal Secretary job, or you could be an experienced candidate looking to make the move to a major law firm. Whatever your experience, we have put together some helpful tips on how to answer common Legal Secretary interview questions to reflect the best of your abilities.

8 Tips to Help You Retain Information

One of the great things about ILSPA’s Legal Secretaries Diploma is that it is not assessed through closed book exams. The focus is put on your understanding of the course material, rather than how well you can memorise it. Law and procedure can require in-depth study and a lot of concentration. Students who are able to train their brains to retain information will find it easier to process and move through the learning material with confidence.

Here are eight quick and easy tips to help you retain information:

1. Repetition

An Overview of Legal Practice

A key feature of ILSPA’s Legal Secretaries Diploma course is the exposure that it gives Students to different areas of legal practice. Each unit integrates the teaching of legal concepts (sometimes referred to as black letter law) with their application in the real world. This approach has employability at its heart and this month we will give you the lowdown about what it is really like to work in some key areas of legal practice. Because there are so many areas of specialisation there is not enough time to consider them all, but we will illustrate some of the close links that exist between legal specialisms.

Performing Well in a Telephone Interview

Telephone interviews continue to grow in popularity within the recruitment process, particularly for urgent roles that need filling fast or first-stage interviews. However, these can be daunting for candidates who may not have experienced one before.

During a telephone interview an employer can efficiently gain a technical understanding of your experience without having to set up a lot of time-consuming formal interviews. Thus, the employer can shorten the hiring cycle. It is therefore crucial that you make a strong first impression to ensure you are shortlisted for a formal interview and make it through to the next stage of the hiring process.

Plastic Pollution in the Thames

It has recently been reported that the River Thames has a higher level of microplastics than any other river in Europe. Larger items such as wet wipes are even accumulating on the shore and creating wet wipe reefs! Scientists are baffled as to why the problem is particularly bad in London and they are calling for stricter regulations on the labelling and disposal of products that contain plastic.

Microplastics can come in the form of glitter and microbeads in cosmetics. These enter the water when we wash them off in the sink or shower after use. However, the majority of microplastics come from the breakdown of larger items, such as food packaging and single-use water bottles.

Returning to Work After Furlough

With businesses reopening and an end date fixed for the furlough scheme, some employers are starting a phased return of their staff. Here’s TotallyLegal’s advice for returning to work after furlough.

According to the results of Business Live’s recent Great Big Business Survey, over half of the businesses polled had taken advantage of the government’s furlough scheme since it came into effect in March, with 28.5% reporting that they had furloughed more than 75% of their workforce.

Searching for New Job Opportunities During COVID-19

The last couple of months spent in lockdown have affected many lives in the legal industry, with staff now working from home, working reduced hours or being furloughed.

Jobs have been more scarce because many employers can’t justify bringing on new staff in these times of uncertainty, so for those who want to remain working in the legal industry, it’s been more challenging to find a new job.

Boundary Setting With Your Boss

The role of an Assistant requires the ability to establish close-knit relationships and a level of trust that only comes from years of close and consistent social interaction with those you support.

Setting boundaries with anyone in life can be difficult. Pushing back and saying no in your career can be tough, especially when you’re fond of the person you’re working with. However, as important as it is to establish a strong connection with your boss, it is equally as important to create and maintain clear boundaries. What if they’re a workaholic, have back-to-back meetings, send emails 24/7 and expect you to be on the same wavelength as them, all on less than a third of their salary?

Family Disputes and Divorce During Lockdown

As with other sectors in the UK, the legal profession has been significantly impacted the past few months. In this article, we are focusing on what changes are being seen by those working in family law.

Family relations are currently being strained in unprecedented ways and many in the legal profession expect there to be a surge in family law-related disputes. This could include a significant rise in the rates of divorce and cases involving finances and children. Divorce will obviously only affect married couples, but issues of money and children can be a problem for anyone.

How to Save Energy at Home

Have you ever thought about how you can save energy at home? Not only will it save you some money, but it will also help the environment. We can go through our everyday lives not thinking properly about the amount of energy we waste however, with the ongoing lockdown, we have a good opportunity to take time to reflect on our habits. It’s amazing how a few small changes can benefit us and the planet!

We have compiled a list of ways in which you can cut down on your energy use at home – and reduce your bills in the process.

It is not the first time there have been calls to reform the Wills Act, but it is unlikely that a quick solution will be found. We will focus on the most pressing current issue (witness requirements), consider possible changes to the law and offer some practical solutions.

Remote work: Here to Stay?

The emergence of remote working has grown from a novel thought to an increasingly sought-after business perk within the legal profession. With the onset of the COVID-19 pandemic mandating that all types of lawyers at all types of seniority level work from home, is remote working here to stay for the considerable future?

Benchmark your salary with SecsintheCity’s Audience Insight Report

SecsintheCity – the UK’s number one job board for PAs, Secretaries and other office support professionals – has just published the findings of its 2019 Audience Insight Report.

In autumn 2019, 4,000 office support professionals responded to our annual salary survey, providing the details of their daily working lives for a report that allows you to benchmark your current earnings and find out more about the stories and statistics behind your profession.

Responses revealed that, at 8%, Legal Secretaries and PAs make up a significant portion of our audience, while 10% of respondents said they were crafting a career in the legal sector.

Using Your Extra Time To Boost Your Career

Due to the ongoing global coronavirus pandemic, the role of office support professionals has changed dramatically, with the office crucially now removed from the equation.

Working from home is a challenging prospect for EAs, PAs and office professionals alike, but remote work can open doors that previously may have been shut. One of the most profound benefits of working from home is the extra time you have on your hands. Remove the commute from the equation, and you’re left with time – both in the morning and the evening – which you can use to focus on yourself.

Staying Productive and Healthy When Working from Home

ILSPA has put together some guidance to help you adapt to the current situation you might be in. If you are working from home, you will find some suggestions on how to work effectively during this time.

Staying Productive

As this may be the first time that you have had to schedule your working day from home, start with getting ready for the day like you would if you were going into the office. Set a morning routine of getting dressed, making your breakfast at a set time and doing whatever else you need to do to be ready for the day ahead.

Building Credibility as an Assistant

Credibility, the quality of being trusted and believed in. One of the most valuable and buildable assets that all Assistants must treat as pivotal to their professional success.

While it is essential to embark on your own journey of continuous professional development, it is important to remember one thing; credibility cannot be learnt in a classroom or over night. Credibility in the workplace is an essential professional asset developed and utilised by the most successful people in the office. Combining a strong set of hard skills with a robust set of soft skills, your level of credibility ultimately defines you as either simply proficient or as a bona fide A-game Assistant.

Everything You Need to Know About Writing a Personal Statement

Writing your personal statement can certainly be tough, but this easy how-to should help.

It’s the first thing a prospective employer will read when they open your CV – for that reason, it’s also the first thing many ambitious job hunters struggle with when making their application.

On the surface, the task of writing a summary of your value as an employee seems straightforward: it’s only a few lines, after all. Yet, considering the competition in the market and the fact that even one spelling or grammar mistake can cause your resumé to be discarded, there’s a lot resting on the profile section of your CV.

How to Start Your CV in Seven Easy Steps

Knowing how to start your CV is bound to set you apart from the rest.

There it is – the job opportunity you’ve been waiting for. The criteria reflect your experience; the responsibilities excite you and the benefits are just the cherry on top.

There’s just one problem: your CV hasn’t been updated in quite some time and could certainly do with a rewrite. If recruiters spend an average of six seconds looking at a CV before deciding whether to read on or skip to the next one, first impressions are paramount to your success. Faced with an empty template, there’s a good chance you’re wondering how to start your CV. Fortunately, we’ve broken the process up into seven easy steps you can follow to create a winning professional resumé:

Performing Legal Research

This month, we will consider how you can go about conducting your own legal research and the approach taken by some lawyers for this common legal task.

Where to research the law

There are two main categories of materials you can consider when researching a legal question:

1. Primary sources of the law

2. Secondary sources

Top Skills for PAs in 2020

Ten years ago, the role of a personal assistant was heavily centred around administrative skills – typing, minute taking, diary management and so on. Now, as we enter a new decade, it is safe to say that the role of the PA has evolved along with technology and a shift in working practices.

Today, the duties of a Personal Assistant stretch far beyond admin – they are now taking on more and more responsibility in the lives of their bosses, clients and the companies they work for.

The role of a modern PA is constantly changing, and no one knows it better than PAs themselves. In this article, we highlight some key skills and top tips that will help you excel as a PA in 2020.

Project Management

What Are Case Management Systems?

Legal case management systems (CMS) are software programs that are designed to help lawyers and law firms manage their cases. They provide the firm with one central location to store and track all client data. This includes things such as contact information, case notes and documents, appointment scheduling and history, client communications, and billing.

If you are a Legal Secretary working in a law firm, you may find a large part of your work is associated with one of these programs. Programs will differ from firm to firm depending on the company’s specific needs, so rarely are two programs exactly the same, although there will be similarities.

What Role Will Paralegals Play in the Future of Legal Services?

As the cost of the services of a talented Solicitor or Barrister skyrockets, and a reduction in legal aid continues, fewer consumers are finding that they can afford costly legal services. They are searching for an alternative.

Paralegals are emerging as that alternative, but the profession still remains an unknown quantity to all but the professional Paralegals themselves, particularly in the eyes of qualified lawyers, who believe Paralegals are simply “would-be Solicitors”.

An Interview with Charlotte O’Brien – Family Legal Secretary at Birketts LLP

Charlotte O’Brien was an experienced PA working for a Director of multiple companies. When her PA role required her to get involved in a High Court case, she felt she needed a better understanding of law and decided to study ILSPA’s Legal Secretaries Diploma. From there, her interest in law grew and she decided to make the move into working as a Legal Secretary.

Charlotte is now a Family Legal Secretary at the award-winning law firm Birketts LLP and is studying our Family Law Advanced Diploma. We spoke to Charlotte about her studies, her job search and how ILSPA’s Diploma helped her in both her previous role and her new role as a Legal Secretary.

Benchmark Your Salary with TotallyLegal’s 2019 Audience Insight Report

In Autumn 2019, over 2,800 legal professionals responded to TotallyLegal’s annual salary survey, sharing the details of their working lives from job title and practice area to PQE level and salary.

From the data provided by our audience, we crafted the 2019 Audience Insight Report – a free to download overview of the legal profession that also allows you to benchmark your current earnings.

With annual pay rises of 54% and 55% respectively, the report revealed a rewarding year for the majority of Legal Secretaries and Legal PAs. Additionally, 50% of Legal PAs and 39% of Legal Secretaries were awarded a bonus on top of their basic salary.

In terms of the gender pay gap, female Legal Secretaries earned 8% more than their male colleagues, and female Legal PAs were awarded a significant 45% more than men in similar roles.

Disclosure and the Consequences of Not Being Transparent

This month we will review what information a property seller should disclose as part of a conveyancing transaction and consider a recent case where a seller has been accused of misleading a buyer by saying nothing.

The starting point in any sale of land is to apply the contractual principle of caveat emptor or buyer beware. However, in practice it is rarely this simple. As part of a normal conveyancing transaction, a seller would complete a property information form in order to give a buyer detailed information about a property. The form has several versions, which cover sales of freeholds, leaseholds and new build residential properties. All of these forms have been designed by the Law Society as part of the national conveyancing protocol used in the majority of transactions in England and Wales.

Progressing from a Secretary to a Legal Secretary

The role of a Legal Secretary is much sought after among workers who want to pursue a career in law. It’s an ideal starting point at which to absorb knowledge of the industry before progressing through the ranks. There are many perks to working as a Legal Secretary – the salary is high compared to that of a standard Secretary and there is opportunity for generously paid overtime. The larger firms also generally offer health benefits and incentives such as ample holiday. London remains the main hub for legal firms, though there is a big market growing outside of the capital in major cities such as Manchester, Leeds and Birmingham.

Law Making in 2020

This month we will consider the Queen’s speech which took place towards the end of 2019 and what new laws we might expect to see in 2020.

The Queen usually only attends Parliament on ceremonial occasions. Last year, she was present at the State Opening of Parliament, where the start of the parliamentary year was marked. At the state opening, the Queen read out her speech from the throne in the House of Lords Chamber. To be more precise, the speech was not actually the Queen’s own words; it had been prepared for her by the Prime Minister, Boris Johnson. The Queen’s speech normally happens once a year, but the last one happened in June 2017 because the Prime Minister at that time, Theresa May, wanted a two-year parliamentary session.
